Scarlett’s Cabaret BIPA Class Action Lawsuit

If you are an individual who visited the Scarlett’s Cabaret nightclub in Washington Park, Illinois between October 20, 2017 and July 18, 2024, and provided your fingerprint in connection with the purchase of a “Dance Dollar,” a class action lawsuit may affect your rights.

The Plaintiffs in this case sued the operators and/or administrators of the nightclub doing business as “Scarlett’s Cabaret” in Washington Park, Illinois. The Plaintiffs allege that the club violated the Illinois Biometric Information Privacy Act (“BIPA”) by obtaining customer’s ink fingerprints when those customers purchased “Dance Dollars” at the club. The operators and/or administrators of Scarlett’s Cabaret (the “Scarlett’s Defendants”) deny Plaintiffs’ allegations and deny that they violated the law.

  • The Court has allowed the claims in this lawsuit to proceed as a class action on behalf of all individuals whose ink fingerprint was placed on a Dollar Dance Form at Scarlett’s Cabaret between October 20, 2017 to July 18, 2024.
  • The Court has not decided whether the Scarlett’s Defendants did anything wrong. There is not yet any money or relief available and no guarantee that there will be.
  • Your options are explained in the Notice.
  • Class counsel must prove the claims against the Scarlett’s Defendants at an upcoming trial scheduled for March 25, 2025. If money or benefits are obtained from the Scarlett’s Defendants, you will be notified about how this relief will be distributed.

If you stay in the class action, you will not be responsible for any legal fees or costs. You do not need to do anything to stay in this class action.

Get out of this class action. Get no benefits but keep your right to bring a separate lawsuit.
